General

The Magic of Scotland website (hereafter referred to as "The Magic of Scotland") has many features that can be enjoyed by non-members.  However, in doing so, we require acceptance of our terms of use. If you do not agree, please stop using our site and its services.

The terms of use below are applicable to the free section of The Magic of Scotland.  Separate terms for subscribers can be viewed on signup and in the Members section.

Copyright and Trademark Law

All editorial content, photographic images, video footage and graphics are protected by UK copyright and international treaties and any violation of copyright is strictly forbidden and will be pursued to the maximum extent possible under the law.  Express written permission must be obtained before using any editorial content or imagery from The Magic of Scotland which reserves all rights.

Limitation of Liability

The services on this website are provided "as seen" and without guarantees of any kind.  Use of The Magic of Scotland is entirely at a user's own risk and any damage to computer or data resulting from visiting The Magic of Scotland is entirely the responsibility of the user.

All warranties, either designated or implied, in addition to limitless warranties, of sale and suitability of purpose are disclaimed as far as the law permits.  This also applies to the non-infringement of proprietary rights.  The Magic of Scotland cannot guarantee that the use of this website will not be interrupted or free of error and that the website or its server will be virus free.  Under no circumstances shall The Magic of Scotland, its Directors, associates or agents be reponsible for any direct or indirect loss or injury or any damages whatsoever arising from the use of this website.  This also applies to any information, service or products accessed from the website, even if The Magic of Scotland has been advised that such damage may be possible.  In the event that the law denies the exclusion of The Magic of Scotland being liable for certain warranties, then the exclusion does not apply to the user to the amount designated by law.

Electronic Cards

Users are entirely responsible and liable for all activities conducted through usage of our services.  The Magic of Scotland shall not be responsible for any content in eCards created on our site

Users must not send anonymous eCards or eCards with fake sender email addresses.

Users must not send eCards with content that is threatening, embarrassing, abusive, harassing, obscene, hateful or otherwise inappropriate.

Users must not add any copyrighted images, music, wording or other content to an eCard unless they own the copyright or have obtained written consent from the owner of the copyrighted material.

Users must not use this service to send eCards to people or other entities on mailing lists and usenet newsgroups that they do not have full rights to use, nor send eCards to people or other entities with whom they are not acquainted.  Sending multiple eCards with advertising content will be considered a contravention of these terms and appropriate measures will be taken to exclude users who deliberately violate this rule.

IP addresses are captured when an eCard is sent and these will be made available to the appropriate authorities in the event of serious violations.

The Magic of Scotland shall have the right, but not the responsibility, to remove eCards which are deemed, at our sole discretion, to be in violation of these terms.

The Magic of Scotland reserves the right to alter these terms at any time.
